As the House knows, the Prime Minister sent out a circular to all the States a few years ago requesting that the portfolio of agriculture in the States should not be neglected; it should be entrusted to an important Minister. I think the National Development Council considered this question and they said that as far as possible, the Chief Ministers in the States should handle the portfolio themselves. And then, they have started a Food Production Board in the Cabinet itself at the Centre, and the National Development Council has decide that an agricultural production board should be started in each State with the Chief Minister as the Chairman. They have started an agricultural machinery board for supplying machinery. They have taken many steps in addition to the normal measures. The Government has been doing their very best in this regard. But with all that, it has not kept up with the targets fixed, unless earnest and vigorous attempts are made. I wish to throw out my own suggestions in this regard. They may not be very pleasant but I wish to be excused because I am speaking from experience. Madam, the first thing is that so far as the producing agency is concerned, its voluntary interest and its enthusiasm must be won. bb) Hier hatte der Geschädigte O ausweislich des medizinischen Gutachtens durch die Schläge und den Tritt einen Jochbeinbruch, multiple Hämatome und Schürfwunden am ganzen Körper erlitten.
a) Die §§ 240, 255, 250 I Nr. 1a Var. 2, Nr. 1c, 223 StGB treten hinter den §§ 250 II Nr. 1, Nr. 3a StGB und § 224 StGB zurück
b) Zwischen der gefärhlichen Körperverletzung und dem besonders Schweren Raub gem. § 250 II StGB besteht Tateinheit, weil die besonders gefährliche Art der Ausführung nicht vom Unrechtsgehalt der §§ 250 II Nr. 1, Nr. 3a StGB erfasst ist, § 52 I StGB.
Er musste operativ versorgt werden und die Heilung erforderte eine zweiwöchige stationäre Behandlung.
c) Zwischen den Schlägen um 1:00 Uhr und dem Schlag um 0:10 Uhr besteht Tatmehrheit, da T die Bar in der Zwischenzeit lange verlassen hatte und nicht mehr von einer einheitlichen natürlichen Handlungseinheit ausgegangen werden kann, §§ 53 I, 54 I StGB.
Mithin lagen krasse Eingriffe in körperliche Integrität sowie langanhaltende und gewichtige Schmerzen vor, weshalb § 250 II Nr. 3a StGB zu bejahen ist.
aa) Hierfür sind derart schwere Folgen wie bei den §§ 226, 239 III Nr. 2 StGB nicht vorausgesetzt. Vielmehr sind bereits solche Verletzungen der Körperlichen Integrität erfasst, die mit langdauernden oder erheblichen Schmerzen verbunden sind.
III. Es ist Untersuchungshaft zu beantragen, §§ 112 ff. StPO
1. Zwar erfordert ein dringender Tatverdacht eine besonders hohe Wahrscheinlichkeit einer verfolgbaren Straftat, jedoch ist die Beweislage erdrückend.
IV. Das LG Stuttgart ist angesichts der zu erwartenden Freiheitsstrafe gem. §§ 250 II, 224 StGB, 53 StGB als große Strafkammer sachlich und örtlich zuständig.
2. Fluchtgefahr iSv. § 112 II Nr. 2 StPO ergibt sich daraus, dass der T keine besonderen sozialien Beziehungen an seinem Wohnort hat, ledig und arbeitslos ist. Insbesondere führt der krasse Strafrahmen von nicht unter 5 Jahren (§ 250 II StGB) angesichts des natürlichen Freiheitsinstinkts zu einem nachvollziehbaren Fluchtwillen.
V. Dem T ist gem. §§ 140 I Nr. 1, Nr. 2, 141 II 1 Nr. 1 StPO ein notwendiger Verteidiger zu bestellen.
3. Hinsichtlich der Verhältnismäßigkeit bestehen keine Bedenken.
VI. Eine Einziehung der Stahlkappenschuhe ist entbehrlich, da sich T mit der Beschlagnahme einverstanden gezeigt hat, §§ 74 ff. StGB.
Es genügt, dass sie über etwas aussagen sollen, was ihnen in ihrer besonderen beruflichen Eigenschaft vom Patienten/Mandanten anvertraut worden ist. Deshalb hat ein Zeugnisverweigerungsrecht auch der Arzt, der das Opfer einer Schlägerei ärztlich versorgt hat.
Zeugnisverweigerungsrecht und Untersuchung gemäß § 81c StPO. Ebenso wie ein Zeuge die Aussage nach § 52 StPO verweigern darf, kann er sich auch einer Untersuchung nach § 81c StPO widersetzen.
Demgegenüber ist Beschlagnahmefreiheit iSd § 97 StPO nur gegeben in den Fällen, in denen der Patient/Mandant Beschuldigter ist
Er ist deshalb gemäß § 81c III 2, V iVm § 52 III 1 StPO vom Anordnungsberechtigten über dieses Recht zu belehren, selbst wenn er schon über sein Zeugnisverweigerungsrecht belehrt worden war.
Bei den Zeugnisverweigerungsrechten der Berufsgeheimnisträger (§ 53 StPO) ist das für bestimmte Berufsgruppen geltende umfassende (Abs. 1) bzw. eingeschränkte (§ 160a II StPO) Ermittlungsverbot im Zeugnisverweigerungsberechtigten Bereich zu beachten.
Ein Verstoß macht das Untersuchungsergebnis unverwertbar, es sei denn, der Zeuge stimmt nach nachgeholter Belehrung zu oder verzichtet später nach Belehrung auf sein Recht aus § 81c III StPO.
Hinsichtlich des Zeugnisverweigerungsrechts der Steuerberater, Rechtsanwälte und Ärzte ist zu beachten, dass es für das Recht auf Zeugnisverweigerung nicht darauf ankommt, dass ihr Mandant bzw. Patient Beschuldigter war, dieser kann auch „Dritter“ sein.
Ein Verwertungsverbot besteht auch dann nicht, wenn sicher auszuschließen ist, dass der Zeuge bei einer formell ordnungsgemäß erfolgten Belehrung von seinem Untersuchungsverweigerungsrecht Gebrauch gemacht hätte, zB bei mehrmaliger Belehrung über sein Zeugnisverweigerungsrecht bei der Polizei und in der Hauptverhandlung.
Selbstverständlich darf im Falle der fehlenden richterlichen Belehrung auch der Sachverständige nicht zu den Angaben gehört werden, die der in der Hauptverhandlung das Zeugnis verweigernde Angehörige im Rahmen einer Exploration zur Erstellung eines Glaubwürdigkeitsgutachtens gegenüber dem Sachverständigen gemacht hat
